INFORMATION PROVIDED TO DATA SUBJECTS DURING THE PROCESSING OF PERSONAL DATA AND INFORMATION ON RIGHTS

The information provided to data subjects during the processing of personal data and the rights notice are an integral part of the general terms and conditions of the DOLCE FELICITA s.r.o., Tupého 14452/58, 831 01 Bratislava, Slovak Republic, ID No.: 56 257 317, VAT ID No.: SK2023074196, registered in the Commercial Register of the District Court Bratislava I, Section Sro, Insert No. 143293/B (hereinafter referred to as the “Operator”). In connection with the processing of the personal data of the buyers (hereinafter referred to as the “data subject”), the Operator, as the seller, hereby provides the following information to the data subjects in accordance with Section 19 of Act No. 18/2018 Coll. on the Protection of Personal Data:

  1. The operator of the information system is the company DOLCE FELICITA s.r.o., with registered office at Tupého 14452/58, 831 01 Bratislava, Slovak Republic, ID No.: 56 257 317, VAT No.: SK2023074196, registered in the Commercial Register of the District Court Bratislava I, Section Sro, Insert No. 143293/B. The data subject may contact the controller at the address of the registered office or at the e-mail address info@dolcefelicita.com.
  2. The controller processes the personal data of the data subject for the purpose of the offer of goods and the subsequent conclusion and performance of the purchase contract between the controller and the data subject and the provision of related services.
  3. The controller also processes personal data for the purpose of sending newsletters and promotional emails (direct marketing) relating to the controller’s own goods and similar services to goods that the data subject has already purchased and services that have been provided to him or her through the online shop on the website https://dolcefelicita.com, in accordance with Article 62(3) of Act No. 351/2011 Coll. on Electronic Communications, as amended. The person concerned is entitled to refuse the sending of newsletters and promotional e-mails at any time, free of charge, either via the Internet link accessible in each newsletter or promotional e-mail, or via an e-mail message sent to the e-mail address: info@dolcefelicita.com. In the case of sending marketing communications about similar goods and services other than the controller’s own, the controller will request consent to the processing of personal data.
  4. The legal basis for the processing of the data subject’s personal data is the performance of pre-contractual measures based on the data subject’s request and the purchase contract, as the processing of the data subject’s personal data is necessary for the performance of the purchase contract.
  5. The legal basis for the processing of the data subject’s personal data in the case of sending newsletters and promotional e-mails (direct marketing) is the legitimate interest of the controller in accordance with Section 13 (1) (f) of the Data Protection Act, which is the further offering of the controller’s own similar goods and services to the data subject. When sending marketing communications about goods and services other than the controller’s own similar goods and services, the legal basis for the processing of the data subject’s personal data is the data subject’s consent in accordance with Section 13(1)(a) of the Data Protection Act, which the data subject is entitled to revoke at any time.
  6. The personal data of the data subject shall not be disclosed to the recipient, except as expressly provided for in generally binding legal provisions (Section 5(q) of the Data Protection Act). The personal data of the data subject may be disclosed to auditors, tax, legal or other advisors and entities that have a legal right to disclose the data. To the extent necessary to fulfill the purpose of the processing of personal data, the personal data of the data subject may also be disclosed to other persons, such as the website administrator, server administrator, external subcontractors, mail carriers and Come. Personal data will not be transferred to a third country (§ 5 (ab) of the Data Protection Act) or to an international organisation (§ 5 (z) of the Data Protection Act);
  7. The controller will keep the personal data of the data subject for a period of 5 (five) years from the conclusion of the last purchase contract between the controller and the data subject and, if no purchase contract has been concluded, for a period of 3 (three) years from the date of their disclosure to the controller.
  8. The data subject shall have the right to obtain confirmation from the controller as to whether personal data concerning him or her are being processed and shall have the right of access to the data and information pursuant to Section 21 of the Personal Data Protection Act.
  9. The data subject shall have the right to rectification of incorrect personal data relating to him or her and, therefore, taking into account the purpose of the processing, the data subject shall have the right to have incomplete personal data completed.
  10. The data subject shall have the right, under the conditions laid down in Article 23 of the Data Protection Act, to have the personal data relating to him or her erased.
  11. The data subject shall have the right to restrict the processing of personal data under the conditions laid down in Section 24 of the Data Protection Act.
  12. The data subject shall have the right, under the conditions laid down in Section 26 of the Data Protection Act, to obtain the personal data concerning him or her which he or she has provided to the controller in a structured, commonly used and machine-readable format and shall have the right to transfer such personal data to another controller, if technically feasible.
  13. The data subject shall have the right to lodge an application for the initiation of data protection proceedings with the Data Protection Authority pursuant to Section 100 of the Personal Data Protection Act.
  14. In the event of rectification, erasure or restriction of the processing of personal data of the data subject by the controller, the controller shall communicate such rectification, erasure or restriction to each recipient of the processing of the personal data, unless this proves impossible or does not require excessive effort. The controller shall inform the data subject of the recipients only if the data subject so requests.
  15. The provision of the data subject’s personal data is a necessary requirement for the conclusion of the performance of the purchase contract and the provision of related services.

In accordance with Section 27(3) of the Data Protection Act, the controller expressly informs the data subject of the right to object to the processing of personal data on grounds relating to him or her, in particular situations carried out pursuant to Section 13(1)(e) or (f) of the Data Protection Act, including profiling based on these provisions, and for the purposes of direct marketing, including profiling to the extent that it is related to direct marketing.
